Privacy Policy

This Privacy Policy explains how ChooseASquare (“ChooseASquare,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit our website, create an account, organize or participate in a contest, use our messaging features, or otherwise use our services (collectively, the “Services”).

ChooseASquare is operated by CHOOSEASQUARE.COM LLC, a Kansas limited liability company, located at 11750 W 135th St, Unit #5090, Overland Park, KS 66221.

ChooseASquare provides software for creating, administering, participating in, and managing recreational competitions, pools, contests, fundraising activities, and related experiences. Features may include squares games, Pick’Em contests, Survivor pools, confidence pools, brackets, drafts, fundraising contests, leaderboards, scoring, participant communications, payment tracking, and other contest-management tools.

Unless expressly stated otherwise for a particular feature, ChooseASquare does not collect, hold, escrow, or transmit money exchanged between participants and organizers. Participants pay organizers directly using payment methods selected by the organizer. We do use a third-party payment processor, currently Stripe, to process payments made directly to ChooseASquare for subscriptions, plans, add-ons, and other paid Services.

1. Information We Collect

Information You Provide

Depending on how you use the Services, we may collect:

  • Account information: Your name, email address, password credentials maintained through our authentication provider, profile information, and optional profile photo. If you use a third-party sign-in service such as Google, we may receive basic profile information from that provider.
  • Mobile information: Your mobile telephone number if you choose to provide one, along with information associated with your messaging preferences and participation in our text messaging programs.
  • Messaging consent information: Records relating to your consent to receive text messages, which may include the mobile number provided, the type of messages you agreed to receive, the date and time consent was provided or withdrawn, the method or location through which consent was obtained, and the version of the consent disclosure presented to you.
  • Organization information: Organization name, public URL or slug, branding such as logos, colors, and banners, and payment information or instructions an organizer chooses to display to participants.
  • Contest and participation data: Contests, pools, grids, brackets, drafts, rosters, schedules, picks, entries, squares or dates claimed, participant display names, contact information, scoring information, payment-status information, contest settings, and other information used to administer or participate in a contest.
  • Communications: Messages you send to ChooseASquare support, feedback you provide, and communications sent or received through features of the Services.
  • Subscription and billing information: When you purchase a paid ChooseASquare plan, subscription, add-on, or other paid service, our payment processor collects and processes your payment-card information. ChooseASquare does not store full payment-card numbers. We may retain information such as a payment processor customer reference, transaction information, the products or plans purchased, billing interval, and subscription status.

Information Collected Automatically

When you use the Services, we may automatically collect:

  • Usage and device data: Pages viewed, features used, actions taken, referring pages, approximate location derived from IP address, browser type, operating system, and device information.
  • Activity logs: To operate contests, maintain security, help ensure contest integrity, and assist organizers in resolving disputes, we may maintain timestamped records of actions such as sign-ins, picks, pick changes, entries, submissions, and payment confirmations. These records may include associated IP addresses and device or browser information.
  • Messaging data: If you participate in our text messaging programs, we may receive information concerning message delivery, message status, opt-in and opt-out requests, HELP requests, inbound messages, timestamps, and related communications metadata.
  • Cookies and similar technologies: We use cookies, local storage, and similar technologies to operate the Services, keep users signed in, remember preferences, maintain security, and understand how the Services are used. We may use analytics providers such as Google Analytics. We do not currently use cookies for third-party behavioral advertising. Where required by law, we may provide cookie consent controls.

2. How We Use Information

We may use personal information to:

  • provide, operate, maintain, and secure the Services;
  • create and manage user accounts;
  • create, operate, administer, score, and display contests;
  • process subscriptions and purchases made directly from ChooseASquare;
  • manage plans, subscriptions, renewals, add-ons, and cancellations;
  • send account, security, authentication, transactional, and service-related communications;
  • send contest-related communications, including invitations, reminders, deadlines, pick or entry confirmations, results, scoring updates, winner notifications, payment-status information, and organizer announcements;
  • send marketing or promotional communications where you have separately consented to receive them;
  • maintain records of messaging consent and opt-out requests;
  • provide customer support and respond to inquiries;
  • personalize and improve the Services;
  • conduct analytics and troubleshoot technical problems;
  • detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms;
  • enforce our agreements and policies; and
  • comply with legal obligations and lawful requests.

Where applicable data-protection laws such as the EU or UK GDPR apply, our legal bases for processing may include performance of a contract, legitimate interests, compliance with legal obligations, and consent.

3. Text Messaging and Mobile Information

ChooseASquare may provide SMS, MMS, RCS, or other mobile messaging programs.

These programs may include service and contest-related messages as well as separately offered marketing and promotional messages.

Service and Contest Messages

If you opt in to receive service or contest-related text messages, we may use your mobile number to send communications concerning your account or contests that you organize or participate in.

These may include account notifications, verification messages, contest invitations, reminders, deadlines, picks, entries, scoring updates, results, winner notifications, payment-status information, organizer announcements, and other operational communications relating to the Services.

Message frequency varies depending on your account activity, contest participation, settings, and organizer communications.

Marketing Messages

If you separately opt in to marketing or promotional text messages, we may use your mobile number to send information about ChooseASquare products, services, features, promotions, offers, events, contest ideas, and related information.

Marketing text-message consent is optional and is not a condition of purchasing or using ChooseASquare products or Services.

Message frequency varies. Message and data rates may apply.

SMS Consent Is Separate

Consent to receive marketing text messages is obtained separately from consent to receive service or contest-related text messages and separately from acceptance of our Terms & Conditions.

You may decline optional SMS messaging without being prevented from creating an account, purchasing a service, or otherwise using ChooseASquare, except where a particular optional feature necessarily relies on text messaging to function.

Opting Out

You may opt out of a ChooseASquare text messaging program at any time by replying STOP to a message from that program.

You may reply HELP for assistance.

Additional opt-out keywords may also be supported.

Opting out of one messaging program may not automatically withdraw consent from a separate messaging program for which you separately opted in.

Mobile Information and Messaging Consent

ChooseASquare does not sell, rent, trade, or share your mobile telephone number, text messaging opt-in data, or messaging consent with third parties or affiliates for their own marketing or promotional purposes.

Mobile information and text messaging originator opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes.

We may disclose mobile information to service providers and subcontractors that perform services on our behalf, such as communications infrastructure providers, customer-support providers, hosting providers, and other vendors necessary to deliver and operate the Services. These providers may use the information only as necessary to provide services to ChooseASquare and not for their own marketing or promotional purposes.

For example, ChooseASquare currently uses Twilio to facilitate certain SMS and mobile communications. Information necessary to send, receive, route, and manage those communications may be processed by Twilio on our behalf.

Messaging consent is specific to ChooseASquare and the applicable messaging program. We do not transfer your consent to unrelated businesses or allow another business to rely upon your ChooseASquare messaging consent to send its own marketing messages.

4. How We Share Information

We do not sell your personal information.

We may disclose information in the following circumstances:

Organizers and Participants

Information necessary to operate a contest may be shared between the organizer and participants in that contest.

For example, an organizer may see who has claimed a square or submitted an entry, participant contact information made available for contest administration, payment-status information, and other contest activity. Participants may see contest boards, entries, standings, results, display names, or other information necessary for the contest experience.

Certain paid or administrative features may allow organizers to view activity information associated with their contests to administer those contests and resolve disputes.

Service Providers

We use service providers to help operate ChooseASquare. Depending on the Services being used, these may include providers such as:

  • Supabase for database, authentication, and storage infrastructure;
  • Stripe for payment processing;
  • Twilio for SMS and communications infrastructure;
  • Google for optional sign-in, analytics, or related services;
  • Vercel for hosting and content delivery; and
  • sports-data providers used to provide schedules, teams, scores, statistics, and related information.

These providers process information as necessary to perform services on our behalf and are subject to their own contractual and privacy obligations.

For clarity, disclosure to service providers does not include permission to use mobile telephone numbers or text messaging consent for their own marketing or promotional purposes.

Legal and Safety

We may disclose information if reasonably necessary to:

  • comply with applicable law, regulation, legal process, or lawful government request;
  • enforce our Terms or other agreements;
  • detect or prevent fraud, abuse, security incidents, or illegal activity; or
  • protect the rights, property, or safety of ChooseASquare, our users, or others.

Business Transfers

Information may be transferred as part of a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar business transaction.

Any successor receiving personal information remains subject to applicable law and the commitments applicable to that information.

Text messaging opt-in data and consent will not be transferred or used for third-party marketing or promotional purposes merely as a result of such a transaction.

5. Payments and Money

Unless expressly stated otherwise for a particular feature, ChooseASquare does not collect, hold, escrow, or transmit funds exchanged between contest participants and organizers.

Those payments are made directly between participants and organizers using payment methods selected by the organizer.

ChooseASquare may provide tools that allow organizers to record, track, reconcile, or communicate about those payments, but doing so does not make ChooseASquare a party to the underlying transaction.

Payments made directly to ChooseASquare for subscriptions, plans, add-ons, or other Services are processed by our payment processor, currently Stripe. Stripe’s processing of payment information is governed by its own privacy practices.

6. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain your account, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements.

Contest and activity information may be retained during a contest and for a reasonable period afterward to maintain records and assist with disputes.

Messaging records, including consent and opt-out records, may be retained for as long as reasonably necessary to demonstrate compliance with applicable communications laws, carrier requirements, and industry standards.

When you delete your account, we generally delete or anonymize personal information within approximately 90 days, except where information must be retained for legal, security, fraud-prevention, dispute-resolution, consent-recordkeeping, or other legitimate purposes.

Some information may remain in backups for a limited period.

7. Security

We use administrative, technical, and organizational measures designed to protect personal information.

These measures may include encryption in transit, authentication controls, database access controls, row-level security, access restrictions, monitoring, and other safeguards appropriate to the Services.

No method of transmitting or storing information is completely secure, however, and we cannot guarantee absolute security.

8. Your Rights and Choices

Depending on where you live, you may have rights regarding your personal information, including rights to:

  • access personal information we maintain about you;
  • correct inaccurate information;
  • request deletion of information;
  • obtain a portable copy of certain information;
  • object to or restrict certain processing;
  • withdraw consent where processing is based on consent; and
  • appeal certain decisions concerning privacy requests.

You can update certain information and preferences through your ChooseASquare account or contact us to exercise applicable privacy rights.

We will not discriminate against you for exercising rights provided by applicable privacy law.

Residents of states with comprehensive privacy laws may have additional rights under applicable state law.

ChooseASquare does not sell personal information and does not currently share personal information for cross-context behavioral advertising.

Communication Preferences

You may unsubscribe from marketing emails using the unsubscribe mechanism included in those communications.

For text messaging, reply STOP to the applicable messaging program to withdraw SMS consent. Reply HELP for assistance.

Withdrawing consent to optional marketing communications does not affect your ability to use the Services.

We may still send communications that are necessary to provide a service you request or otherwise permitted by law.

9. Children’s Privacy

ChooseASquare accounts intended for contest organizers are designed for adults.

We do not knowingly collect personal information directly from children under 13 without appropriate authorization.

Participants in contests, team activities, school fundraisers, or similar activities may include minors. Organizers are responsible for obtaining any parental or guardian consent required by applicable law before submitting information about minors or inviting minors to participate.

If you believe a child under 13 has provided personal information to us without appropriate authorization, contact us and we will investigate and take appropriate action.

10. International Users

ChooseASquare operates in the United States.

Our service providers may process information in the United States and other countries. If you access the Services from outside the United States, your information may be transferred to and processed in countries whose privacy laws differ from those where you live.

Where required, we use appropriate safeguards for international transfers of personal information.

11. Third-Party Links and Services

The Services may contain links to third-party websites, applications, payment services, or other services.

ChooseASquare is not responsible for the privacy practices of independent third parties. Information you provide directly to a third party is governed by that party’s privacy policy.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to the Services, our practices, technology, legal requirements, or other factors.

When we make changes, we will post the updated Privacy Policy and revise the “Last updated” date.

Where required by law, we will provide additional notice or obtain additional consent.

Changes to this Privacy Policy will not by themselves expand the scope of any consent you previously provided to receive marketing text messages.
